REALTOR® Advocacy Delivers New Protections Against Predatory Wholesaling

Beginning Aug. 28, Missouri will implement new consumer protection measures for certain residential wholesaling transactions, marking an important step forward for homeowners, property rights and transparency in the real estate marketplace. The legislation, enacted through Senate Bill 973, establishes disclosure requirements intended to ensure property owners have a clear understanding of the transaction before entering into a contract.

Under the new law, wholesalers purchasing residential properties containing one to four dwelling units must provide sellers with written disclosures explaining key aspects of the transaction, including whether the contract may be assigned to another buyer for profit and whether the wholesaler intends to take title to the property. The law also establishes a 14-day waiting period before a purchase contract may be executed.

Importantly, the legislation does not prohibit wholesaling. Rather, it recognizes that homeowners deserve transparency and the opportunity to make informed decisions when selling what is often their most valuable financial asset.

The new requirements are particularly meaningful for consumers who may be vulnerable to predatory practices, including those managing inherited property, homeowners facing financial hardship and individuals navigating significant life transitions. By requiring greater disclosure and allowing additional time for consideration, the law empowers consumers with the necessary information to fully evaluate their options before moving forward with a transaction.

For years, REALTORS® across Missouri have raised concerns about situations in which homeowners entered agreements without fully understanding the nature of a wholesale transaction or the alternatives available to them. This legislation reflects a simple but powerful principle: consumers should never have to make major financial decisions without the information needed to do so confidently and knowingly.
