In preparation for the full implementation of the Clear Cooperation policy, Heartland MLS will discontinue the availability and use of Temporary and Permanent Waivers this Wednesday, April 1.
Without the use of Temporary Waivers, agents who need a property to be entered in the Pre MLS status will note it as such in the new Exclusive Right to Sell Contract, which is currently available in the KCRAR forms library in the Member Portal, dotloop and FormsRUs. This new form offers a checkbox to denote if the seller would like his or her property in the Pre MLS status. Properties in this status may not be shown, and if they are shown, that property must be immediately changed to Active, or no later than 24 hours to avoid a penalty (see section 7.3 of the Heartland MLS Rules and Regulations for more details regarding penalties).
A new form has also been created for “Private Office Exclusive” listings, for sellers who do not want their properties publicly marketed. This form is also currently available in the KCRAR forms library and should be submitted to Heartland MLS on poe.kcrar.com within two calendar days of obtaining required signatures, including broker signature. Listings under this contract may not be publicly advertised and may only be shared with agents within the listing brokerage, defined by the MLS Office ID.
Temporary and Permanent Waivers will no longer be accepted by Heartland MLS on April 1. Agents who currently have properties on waivers have received direct communication from Heartland MLS to outline necessary action.
